A method for controlling a data rate of a voice service in a mobile communication system which supports a voice service through a packet network and a device therefor are provided to enable an RNC(Radio Network Controller) to transmit a DL(Downlink) AMR(Adaptive Multi Rate) rate control message to a terminal, so that the terminal can properly set a CMR(Change Mode Request) field value of a UL(Uplink) VoIP(Voice over Internet Protocol) packet. A control message receiver(930) detects desired DL frame type information of a DL voice CODEC(Coder Decoder) rate control message received from an RNC, and detects desired UL frame type information of a UL rate control message received from the RNC. A CMR field controller(920) determines a CMR field value indicative of a DL rate in accordance with the desired DL frame type information. An AMR rate controller(910) determines a UL rate according to the desired UL frame type information. An AMR header inserter(915) inserts the CMR field value into a header of a UL voice packet. An AMR CODEC(905) converts a voice signal into voice data according to the determined UL rate, and converts voice data included in a DL packet into a voice signal. A transceiver(935) transmits a UL voice packet including the voice data and the header to an RNC, and receives a DL voice packet from the RNC to send the received packet to the CODEC(905).
