The present invention is a technique that allows users of the first and second groups to share access to a communication channel, such as a wireless channel. The first group user is typically a legacy group user, such as using digital CDMA cellular telephone equipment. The second group of users is a group of data users who code the transmission in different formats optimized for the data function. The first group users share the same modulation scheme as on the reverse link, using the unique phase offset of the common pseudorandom noise (PN) code. The second group user matches the first group user and shares another modulation structure in a compatible way. Specifically, the second group of users may use the same PN code and code phase offset. However, the second group of users are uniquely identified by, for example, each being assigned a unique orthogonal code.
