PROBLEM TO BE SOLVED: To provide a communication apparatus capable of performing a spread code allocating operation in a scheduler while avoiding constraints for novel user allocation and a method.

SOLUTION: A receiving RF part 201 receives a plurality of codewords (CW) each of which is mapped to one or more layers. A CRC detection part 209 performs error detection on each of the plurality of received CW and a PHICH generation part 210 transmits ACK/NACK information indicating a result of the error detection for each of the plurality of CWs. In the case where the CRC detection part 209 detects an error for one CW mapped to the plurality of layers and the receiving RF part 201 receives one CW re-transmitted from a communication party apparatus and mapped to the plurality of layers regardless of whether a common orthogonal sequence or different orthogonal sequences are used for the plurality of layers in the first transmission a retransmission combination part 207 demodulates one CW using a spread code including the common orthogonal sequence.
